Dhaka, July 29 (V7N)- The Appellate Division of the Supreme Court has stayed a High Court order that prevented authorities from showing an accused as arrested in a new case without a specific charge.
The Appellate Division issued the order on Wednesday, following an appeal against the High Court's decision.
Earlier, a High Court bench comprising Justice Razik Al Jalil and Justice Debashish Roy Chowdhury had ruled that no person could be arrested without a specific case. The court had also issued a rule seeking an explanation on the matter.
On Wednesday, the Appellate Division directed that the High Court rule be disposed of within four weeks while staying the effect of the previous order.
Attorney General Mohammad Ruhul Quddus Kajal said the High Court's decision could have affected the independent investigation process of law enforcement agencies. He said such a restriction could prevent authorities from taking action even when they have specific evidence against an individual.
The Attorney General also said the court has set next Sunday for a hearing on showing former Chief Justice ABM Khairul Haque arrested in a new case.
